1) Eligibility & basic rules
-
You must be at least 18 years old (or the age of majority in your jurisdiction).
-
Use the Site lawfully and do not infringe any third-party rights.
-
We may modify, suspend, or terminate the Site or your access at any time.
2) No financial, investment or legal advice
-
Content on the Site is for informational purposes only and does not constitute financial, investment, tax, accounting, or legal advice.
-
ENE (Energy Credit) is a crypto token with market and technology risks. Do your own research (DYOR) and consult independent professional advisors.
3) Third-party links & services
-
The Site may link to third-party services (e.g., Uniswap, block explorers, analytics, social media). We do not control or endorse third parties and are not responsible for their content, availability, fees, or policies.
-
Your use of third-party services is governed by their own terms.
4) Wallets, security & risk
-
You are solely responsible for the security of your devices, wallets, private keys, seed phrases, and on-chain transactions.
-
Blockchain transactions are typically irreversible. We do not recover funds, reverse transactions, or provide custody.
-
Using smart contracts and DeFi protocols involves risks, including contract bugs, exploits, MEV, slippage, price impact, oracle failures, and network congestion.
4A) Liquidity & admin controls (on-chain)
-
Liquidity for the ENE token on decentralized exchanges (e.g., Uniswap) may be controlled by the token deployer/owner or third parties. Liquidity may or may not be locked and can be added, migrated, or removed at any time.
-
Removing/migrating liquidity can materially affect price, slippage, and the ability to trade (including temporary or permanent loss of market depth).
-
The ENE smart contract and/or its surrounding infrastructure may include admin/owner privileges (for example, without limitation: adjusting parameters/fees, pausing/restricting functions, mint/burn if programmed, upgrading proxies if applicable, or setting allow/deny lists). You must verify the current state on-chain; do not rely solely on the Site.
-
The Site operators are not the token owner or liquidity controller and do not control admin keys. We make no promise to lock liquidity, renounce ownership, or keep parameters unchanged. If ownership is renounced in the future, such status will be visible on-chain.
-
Before interacting, check contract and pool information on Etherscan/DexTools and assess risks, taxes/fees (if any), and current parameters.
5) Prohibited jurisdictions & compliance
-
You may not use the Site where doing so would violate applicable laws or regulations (including OFAC-sanctioned jurisdictions or persons). You are solely responsible for compliance in your location.
-
We may restrict or block access where we reasonably believe it is required by law.
6) Taxes & reporting
-
You are solely responsible for any taxes, filings, or reporting obligations related to your activities (including any gains/losses) involving ENE or other digital assets.
7) No warranties (AS IS)
-
The Site and any content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted or error-free operation, or accuracy).
-
We do not guarantee prices, liquidity, availability, network uptime, or the absence of vulnerabilities.
8) Limitation of liability
To the maximum extent permitted by law, we and our contributors, community volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Site, ENE, smart contracts, or third-party services.
In any event, our aggregate liability shall not exceed the greater of (a) USD $100 or (b) the amount you paid to us for the Site (typically $0).
Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted.
9) Release & indemnity
You release and forever discharge us (and our contributors, community volunteers, and affiliates) from any and all claims, liabilities, demands, and damages arising out of or related to your use of the Site, ENE, smart contracts, or third-party services.
You agree to indemnify, defend, and hold harmless us (and our contributors, community volunteers, and affiliates) from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
10) Dispute resolution; arbitration; class-action waiver (U.S.)
-
Governing law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts of law.
-
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat/venue shall be Wilmington, Delaware, and hearings may be conducted virtually unless the arbitrator orders otherwise.
-
No class actions: You and we waive any right to participate in a class or representative action. Only individual claims may be arbitrated.
-
Injunctive relief: Either party may seek temporary injunctive relief in a court of competent jurisdiction to preserve the status quo pending arbitration.
If any part of this Section is found unenforceable, the remainder shall be enforced to the maximum extent possible, and the unenforceable part shall be severed.
11) Changes to the Site or these Terms
We may update the Site and these Terms at any time. Changes become effective when posted on the Site. Your continued use after changes are posted constitutes acceptance.
12) Entire agreement; severability; assignment
These Terms are the entire agreement between you and us regarding the Site. If any provision is found invalid or unenforceable, it shall be severed and the remainder shall remain in full force. You may not assign or transfer these Terms; we may do so without restriction.
